RECRUITMENT AGREEMENT: PERMANENT AND TEMP TO PERM ASSIGNMENTS


CONDITIONS OF SERVICE:

Omnistaff provides a unique range of Recruitment Management solutions based on the principal of high value, cost-effectiveness and tailored services. Our aim and passion is to improve our clients' recruitment performance capacity, maximising their profitability through the utilisation of our staffing services.

The placement fee is payable by the Client upon the engagement of a candidate introduced by Omnistaff to the Client or subsequently introduced by the Client to a third party within a 12 (twelve) month period commencing as and from the date of the introduction.

In the event that an Omnistaff assignee introduced by Omnistaff thereafter being permanently or temporarily employed by the Client and/or said third party or permanently or temporarily employed by the Client and/or third party through the offices of another staffing services company within a 12 (twelve)month period, a permanent placement fee will be charged to the Client.

The placement fee will be calculated according to the total cost to the company as set out below:

FEE STRUCTURE

The fee shall be calculated on the Gross Total Cost to Company Annual Package of the candidate, calculated according to the guaranteed remuneration in the first year of employment with the Client and charged as follows:

Guaranteed remuneration will include but not be limited to the candidate’s salary, vehicle allowance, 13th Cheque, Medical Aid and Provident Fund, sign on bonuses and any further remuneration required to secure the candidate’s employment.

The placement fee is payable within Seven (7) days of the candidate commencing employment with the Client.

Commission only placements will be based on a flat fee of R7 000 exclusive of VAT.

GUARANTEE:

Omnistaff undertakes to provide a Ninety (90) day guarantee period for all salaried candidates placed.
Our guarantee period is validated on receipt of payment received in full within Seven (7) days of the candidate commencing employment. In the event of the employee leaving the Client's employ for any reason within the stipulated guarantee period, Omnistaff will recruit a replacement candidate, taking into account the differences in the candidate’s packages. A 100% credit will be passed for the first candidate and the Client will be invoiced for the replacement on the new fee calculated

Rebates: Should the Client not find a suitable replacement candidate, or not require a replacement candidate - providing the original candidate has left, the Client will qualify for a rebate. If the candidate leaves within the first month of employment, an 80% rebate of the placement fee will be credited. A 50% rebate will apply if the candidate leaves in the second or third month.

Please note that if the guarantee is not validated the Client will not be entitled to receive a replacement candidate or a rebate.    
If the employee resigns or is terminated for reasons other than:

    1. The original terms and conditions of employment being altered by the Client;
    2. The original job specification being altered by the Client;
    3. Retrenchment;
    4. A claim of constructive dismissal or an unfair dismissal dispute arises and an unfair dismissal claim is lodged  by the Candidate
    5. Requests for replacements or rebates must be made in writing to Omnistaff within 7 days prior to employee’s termination date.
